Visitor Information on Data Processing, in accordance with Article 13 of Regulation (EU) 2016/679 (GDPR) – VIDEO SURVEILLANCE

In compliance with Article 13 of Regulation (EU) 2016/679, the Provision on video surveillance - April 8, 2010, by the Privacy Authority, and the Guidelines 3/2019 of the European Data Protection Board (EDPB), we provide the necessary information regarding the processing of personal data carried out through a video surveillance system.

 

TYPES OF DATA PROCESSED - Personal data: any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, particularly by reference to an identifier such as a name, identification number, location data, an online identifier, or one or more specific elements of their physical, physiological, genetic, mental, economic, cultural, or social identity. Specifically, your image will be processed.

 

DATA CONTROLLER, pursuant to Articles 4 and 24 of Regulation (EU) 2016/679, is HOTEL LE FONTANELLE S.R.L., with legal headquarters at Via Roma 11 – 53017 Radda in Chianti (SI) and operational headquarters at SP 408 - km 14.7 – 53019 Pianella, Castelnuovo Berardenga (SI), represented by the President of the Board of Directors, the legal representative pro tempore. PURPOSE OF PROCESSING, LEGAL BASIS, STORAGE PERIOD, AND NATURE OF CONFERRAL

  • PURPOSE OF PROCESSING: Personal data will be processed in compliance with the lawfulness conditions under Article 6 of Regulation (EU) 2016/679 for the purposes of security and protection of company assets and individuals.
  • LEGAL BASIS: Pursuant to Article 6 of the GDPR, processing is necessary for the pursuit of the legitimate interest of the data controller or third parties (security and protection of company assets and individuals), provided that the interests or rights and fundamental freedoms of the data subject requiring the protection of personal data do not prevail (C47-C50) and based on Opinion 6/2014 on legitimate interest from the Article 29 Working Party for data protection.
  • STORAGE PERIOD: In accordance with Article 5, paragraph 1, letter e) of Regulation (EU) 2016/679, personal data collected will be stored in a form that allows for the identification of data subjects for no longer than is necessary to achieve the purposes. Images are retained for a maximum of 24 hours from detection, except for any periods related to holidays, closures, or specific investigative requests from law enforcement and/or the judiciary.
  • NATURE OF CONFERRAL: The provision of data is necessary, as it is strictly instrumental for access to the data controller’s facility. In the absence of such provision, the controller will be unable to grant access to the facility.

     

RECIPIENTS OR CATEGORIES OF RECIPIENTS OF DATA

Personal data will be communicated to recipients appointed under Article 28 of Regulation (EU) 2016/679, who will process the data as data processors, and to those designated under Article 29 of Regulation (EU) 2016/679 as natural persons acting under the authority of the Data Controller and/or the Processor. Specifically, data may be communicated to recipients belonging to the following categories: - internal authorized personnel; - individuals designated for the management/ maintenance/ administration of the video surveillance system; - public officials and/or judicial authorities, upon request. Individuals belonging to the aforementioned categories perform the role of Data Processor or operate independently as distinct Data Controllers. The list of Data Processors is constantly updated and available upon request by contacting the Data Controller at the email address privacy@fontanellestate.com or through the other contacts provided above.

 

RIGHTS OF DATA SUBJECTS

You may exercise your rights as expressed by Regulation (EU) 2016/679 in Articles 15, 17, 18, 19, and 21 by writing to the Data Controller at the e-mail address privacy@fontanellestate.com. You have the right, at any time, to request access to your personal data, the deletion of the same, and the limitation of processing. 

Additionally, you have the right to object, at any time, to the processing of your data based on legitimate interest. You also have the right to lodge a complaint with the supervisory authority (Guarantor for the protection of personal data https://www.garanteprivacy.it). For information on the allocation, number, and range of action of the cameras, as well as the activation time slots, you can contact the Data Controller using the contacts provided above.

 

TRANSFER OF DATA TO A THIRD COUNTRY

Personal data will not be transferred to non-EU countries.
